Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CarePlan Pro (the “Service”), operated by CarePlan Pro (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility and Accounts
You must be at least 18 years old and a licensed nursing professional, MDS coordinator, or other healthcare administrator authorized to use clinical documentation tools at your facility. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Description of the Service
CarePlan Pro is a software tool that generates draft care plan documentation aligned with Mississippi PDPM Supportive Documentation Requirements (effective October 1, 2025). The Service uses third-party large language model APIs (provided by Anthropic) to produce care plan content based on the resident-specific information you enter.
3. Clinical Review Required
The Service does not replace clinical judgment. All care plans generated by the Service must be reviewed and approved by a licensed nurse or MDS coordinator before entry into any medical record. The Service produces draft documentation only. You are solely responsible for the accuracy, completeness, and clinical appropriateness of any care plan you enter into a resident’s medical record.
4. Subscriptions, Trials, and Billing
The Service is offered on a monthly subscription basis. New accounts include a 7-day free trial. A valid payment method is required at signup. You will be charged the applicable plan price on the eighth day after signup unless you cancel before the trial ends. Subscriptions renew automatically each month at the published price until canceled.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period (or, if during a trial, immediately). No refunds are provided for partial billing periods.
5. Acceptable Use
You agree NOT to:
- Enter into the Service any patient health information that you are not authorized to handle under HIPAA, your facility’s policies, or applicable law.
- Use the Service to generate documentation for residents you are not directly responsible for or authorized to document.
- Reverse engineer, scrape, decompile, or attempt to derive the source code of the Service.
- Resell, redistribute, or sublicense access to the Service.
- Use the Service in a manner that would violate any applicable law, regulation, or third-party right.
6. Privacy and Data
The Service does not store resident health information. Care plan content you enter is processed through the Anthropic API and is not retained by CarePlan Pro after the response is returned. We collect only your account information (email, name, facility, billing details). See our Privacy Policy for details.
7. Intellectual Property
The Service, including its prompts, templates, and source code, is owned by CarePlan Pro and protected by copyright and other intellectual property laws. Care plan content generated for you is yours to use within your facility’s documentation workflow; the underlying templates and prompt logic are not.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CLINICAL ACCURACY. The Service is a documentation aid; clinical accuracy of any output depends on the information you provide and the clinical judgment you apply during review.
9. Limitation of Liability
To the maximum extent permitted by law, CarePlan Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may terminate your account at any time by canceling your subscription from your account settings.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via the email associated with your account. Continued use of the Service after a change constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Mississippi.
